OPT-OUT NOTICE FORM
For U.S and Canadian Users Only

    Under Art. 26.8.3 of our Terms of Use you have the right to opt out of the binding arbitration agreement and the class action waiver included in our Terms of Use.
    If you do not wish to be bound by the binding arbitration and class action waiver set out in our Terms of Use you must submit your opt-out notice within 30 days, unless a longer period is required by applicable law (the “Opt-Out Deadline”).
    IN ORDER TO VALIDLY TERMINATE THE ARBITRATION AGREEMENT, WE MUST RECEIVE YOUR OPT OUT NOTICE NO LATER THAN 3 DAYS AFTER THE OPT-OUT DEADLINE FOR IT TO BE VALID.
    A valid Opt-Out Notice can be sent no later than 3 days after the Opt-Out Deadline in one of the following two alternative ways:
    a) by completing and submitting the below Opt-Out Notice form, OR
    b) by sending an email to notices@funplus.com with the subject line “Terms of use – opt-out notice.” Your email must include cumulatively: (1) your player id, (2) your name, (3) your address (including country), (4) the email address associated with your app store or funplus store account, if you have one, and (5) a clear statement that you do not wish to resolve disputes with us through arbitration.
    ATTENTION: IF WE DO NOT RECEIVE AN OPT-OUT NOTICE FROM YOU, OR IF WE RECEIVE AN OPT-OUT NOTICE FROM YOU MORE THAN 3 DAYS AFTER THE OPT-OUT DEADLINE YOU MUST PURSUE ANY CLAIM IN ARBITRATION OR SMALL CLAIMS COURT.
    Kindly note also that you may not opt out of a prior agreement with FunPlus. So for the avoidance of doubt, if you previously agreed to arbitrate under a prior version of our Terms of Use, that agreement is still binding on you; this opt-out right only applies to the current Terms of Use that differ from your prior agreement.
    Privacy Notice: Your personal data submitted in this Opt-Out Notice Form will be used solely for the purpose of the verification of your opt-out notice and will be processed in accordance with applicable laws and the FunPlus’ Privacy Policy.
