FunPlus Mini-Game & Mini-Sweepstake
Terms and Conditions

We are very pleased to invite you to join our Mini-Game & Mini-Sweepstake Campaign (the “Campaign”). Please read the below terms and conditions of our Campaign below (“Terms”) carefully. 

By participating in the Campaign, you agree to be bound by the Terms:

1. The Campaign is promoted and organized by FunPlus International AG (“FunPlus“). It is in no way sponsored, endorsed, or administrated by, or associated with Facebook, Instagram, VK, Discord, Google, or Twitter.
2. NO PURCHASE OR PAYMENT IS REQUIRED TO ENTER OR WIN.
3. The Campaign begins from and ends at the time and date as specified in the post of the event or the linked announcement for the promotion (e.g., the post on our Facebook Page.)
4. Eligibility: In general, you must be older than 18 years of age or be of legal age in your state of residence. You must be an individual legal resident of one of the following countries: Australia, Austria, Belgium, Belarus, Brazil, Canada, France, Germany, Ireland, Italy, Morocco, Netherlands, New Zealand, Poland, Portugal, Russia, Spain, Switzerland, Ukraine, United Kingdom, United States. (FunPlus’ employees and their immediate family members are not eligible to participate in the Campaign.)
5. You may submit ONLY ONE ENTRY for each Social Media or Customer Account.
6. You may participate in the corresponding Campaign via one of the following channels, depending on the specification in the Campaign announcement: 
   • Follow the rules as specified in the Campaign announcement, and comment on the Campaign post on the Facebook Page of the Game,  including your Player ID (must be written out, screenshots won’t be accepted).   
   • Follow the Twitter account of the Game, follow the rules as specified in the Campaign announcement, and comment on the Campaign Twitter post, including your Player ID (must be written out, screenshots won’t be accepted).
   • Follow the Instagram account of the Game and comment on the Campaign post for that account alongside your Player ID (must be written out, screenshots won’t be accepted).
   • Join the Discord Server of the Game and follow the rules as specified in the Campaign announcement, and leave a message on the dedicated channel of that event including your Player ID (must be written out, screenshots won’t be accepted).
   • Follow the VK account of the Game and the rules as specified in the Campaign and comment on the Campaign post for that account including your Player ID (must be written out, screenshots won’t be accepted).
   • Complete a short survey via the link for the stated channel in the post, if any, and enter your Player ID (must be written out, screenshots won’t be accepted).
7. The odds of winning shall depend on the number of eligible entries received by FunPlus. This will be decided at FunPlus’s sole discretion.
8. Prizes

8.1 Winners will be notified whether they are a winner and winners can claim the prize, both in the manner and within the timeframes as defined in the contest information. FunPlus will endeavor to deliver digital prizes in less than 30 days and ship physical prizes to winners, who claimed in the defined timeframes, in less than 90 days after the campaign has finished.

8.2 Any and all taxes on the prizes are the winners’ sole responsibility. Prizes are not transferable or redeemable for cash. FunPlus reserves the right to make equivalent substitutions as necessary, due to circumstances not under its control. FunPlus will not replace any lost or stolen prize. Prizes are provided “as is”.

9. FunPlus reserves the right to modify or cancel this Campaign at any time.
10. LIMITATION OF LIABILITY
    Insofar as is permitted by law, FunPlus, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of FunPlus, its agents or distributors or that of their employees. Your statutory rights are not affected.

11. INTELLECTUAL PROPERTY RIGHTS  

11.1 All comments, entries, and any accompanying materials submitted to FunPlus will become the property of FunPlus on receipt and will not be returned.

11.2 FunPlus does not claim any rights of ownership in your entries, comments or other accompanying materials subject to paragraph 11.4.

11.3 By submitting your comments, entries and any accompanying materials, you agree to:

11.3.1 assign to FunPlus all your intellectual property rights with full title guarantee.

11.3.2 waive all moral rights, in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the applicable Copyright, Designs and Patents laws as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

11.4 You agree that FunPlus may, but is not required to, make your entry available on any FunPlus Site and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant FunPlus a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.

12. DATA PROTECTION AND PUBLICITY
    FunPlus will only process your personal information as set out in its privacy policy.

13. GENERAL  

13.1If FunPlus has any reason to believe that there has been a breach of these terms and conditions, FunPlus may, at its sole discretion, reserve the right to exclude you from participating in the campaign.

13.2 FunPlus reserves the right to void, suspend, cancel, or amend the prize or the Campaign, in the event FunPlus at its sole discretion acting in good faith deems this necessary, including if any law or regulation is inconsistent with these terms or where any law or regulation makes FunPlus’ performance of these terms impossible, unlawful, illegal or unethical.

13.3These terms and conditions shall be governed by the laws of Switzerland, and the parties shall submit any disputes to the non-exclusive jurisdiction of the courts of Zug, Switzerland.
