FunPlus Subscription Terms

Some of FunPlus’ games may offer subscription services. If you purchase a game subscription, then by clicking the purchase button you are requesting that FunPlus begins supplying the subscription services to you immediately and understand that you are entering into a periodic subscription agreement with us. These Subscription Terms (“Subscription Terms”) apply to the subscription services (“Subscription“) of our games (the “Game(s)”).
These Terms form a legally binding contract between you and us. By accessing or using the Game and the Subscription you accept and agree to these Terms. If you do not agree to these Terms then do not access, purchase or use a Subscription or the Game.
If you purchase a Subscription service for our games via a third-party platform such as Apple or Google, the platform will charge you for the subscription fees and the applicable platform’s payment and subscription terms and conditions shall apply. Please review the appropriate platform’s payment terms and conditions for additional information.
1. ABOUT YOU
1.1 By using the Subscription, you agree that you are at least 18 years of age, or if you are younger than 18 years of age, that you have reviewed these Terms with your parent(s) or guardian(s) and they have agreed to these Terms on your behalf and take full responsibility for your compliance with them. If we are informed by a parent/guardian that their child has misrepresented their age when registering for our Games or a Subscription, we will suspend the relevant account, provided we have information which satisfies us that the reporting person is indeed the parent or guardian of that child.
2. WHO WE ARE
2.1 We are FunPlus International AG, a company registered in Switzerland and located at Bahnhofstrasse 2, 6300 Zug, Switzerland. All references to us in these Terms shall be deemed to include our affiliate and subsidiary companies, unless otherwise stated.

3. CHANGES TO TERMS
3.1 We may change these Terms from time to time, for example in order to ensure that we remain compliant with applicable laws or to reflect any changes we make to the Subscription or otherwise. It is your responsibility to check the Terms regularly before using any of our Services. Your continued use of our Services from the date of change will be deemed your acceptance of the amended Terms.
4. SUBSCRIPTION AND FEE
4.1 The applicable fee and term for the Subscription will be displayed before or when you order the Subscription.
4.2 If we decide to decrease the price of your Subscription, all your existing Subscriptions will automatically renew at the lower price.
4.4 Our games may occasionally offer a one-time or limited-time bonus to players that have a current Subscription or who agree to start a subscription. These items, which will generally be marked as “bonus” items, will not be part of your ongoing subscription.
5. AUTO-RENEWAL AND PAYMENT
5.1 If you opt for auto-renewal, your account will continue to be periodically charged for the Subscription until you cancel your subscription. When you sign up for a Subscription, you must designate and provide information about your preferred payment method – the information you provide must be complete and accurate, and you are responsible for keeping it up to date. Any failure to do so may lead to suspension or cancellation of your access to the Subscription. You expressly authorise us, or the platform on which you purchased your Subscription, to collect via automatic debit from your nominated payment method the appropriate fees charged for any Subscription. Immediately after your initial subscription commitment period has expired, and again at the end of any subsequent subscription period, your subscription will automatically renew and continue, at the subscription price and time period you agreed to on initially commencing the subscription, subject always to any updates in pricing and services issued by us from time to time. Unless otherwise stated, all fees for Subscriptions will be payable in advance and billed automatically at the start of each applicable subscription period. All purchases of Subscriptions are final and non-refundable, except at our sole discretion.
5.3 The Subscription fee will be displayed in the currency Apple or Google charge you from your Payment Method in accordance with the terms and conditions of Apple or Google, as applicable.
6.1 If you do not want your Subscription to renew automatically or if you want to terminate your Subscription, you must log in to your account and follow the instructions to manage or cancel your Subscription or manage or cancel your subscription through the relevant third-party platforms following the steps in 6.4 below (simply deleting your account will not cancel your subscription). If you cancel your Subscription, you may continue to use the cancelled Subscription until the end of your then-current Subscription term. The Subscription will then not be renewed when your then-current term expires.
6.2 If you cancel the auto-renewal of your Subscription more than 24 hours before the expiry of the current term of your Subscription, your Subscription will be cancelled for the subsequent period following the expiry of such current term, and you will not be charged for periods subsequent to your current Subscription term. You will be able to use the Subscription until the expiration of the active Subscription term.
6.3 If you cancel the automatic renewal of your Subscription less than 24 hours before the expiry of the current term of the Subscription, you will be charged for the term immediately following the current term. You will be able to use the Subscription until the expiration of the immediately subsequent term, and your Subscription will be cancelled for periods following such immediately subsequent term.
6.4 You may cancel the auto-renewal of a Subscription via the relevant third-party platform by following the below steps on your device:

7.1 SUBSCRIPTION PAYMENTS ARE NON REFUNDABLE AND THERE ARE NO REFUNDS FOR PARTIALLY USED SUBSCRIPTION PERIODS, EXCEPT FOR THE CASES AS EXPLAINED BELOW.
7.2 In case you reside in the USA, European Union, Canada, UK or Australia, any refunds for paid Subscriptions will be subject to the refund terms, conditions and policies of the applicable platform used for the initial purchase, such as Apple or Google and Subscription services may be cancelled within 14 days from the date of purchase and you may obtain a refund of your initial payment minus a reasonable period portion to cover your use of the Subscription service prior to cancellation. For any FunPlus Games purchased via a third-party platform such as Apple or Google, please refer to the applicable platform payment terms relevant to subscriptions and refunds.

10. LAW AND JURISDICTION
These Subscription Terms are drafted in the English language and may be translated into other languages. The English language version of these Subscription Terms shall at all times prevail if there is a conflict or inconsistency or if a clarification is required.
